How Powers of Attorney Work

Powers of Attorney can be written to become effective immediately, on a certain date, or when you are deemed to be incapacitated. They can also be drafted to end on a certain date or upon your passing. These documents can be designed to be “general” meaning that your designated agent will have the authority to make all decisions concerning the matters you grant, as in a situation where you have been rendered unconscious in an accident or in the final stages of a terminal illness. They can also be specific, such as the power to sign for you in real estate documents or have your taxes done (and sign for you) while you are out of the country.

In general, four types of Powers of Attorney can be made. These include:

  • Durable Powers of Attorney. These give your agent decision-making authority over whatever affairs you name but remain in effect even should you become incapacitated.

  • Special Powers of Attorney. These give limited power to your named agent who is only allowed to act on your behalf in a specific matter.
